1. Acceptance of Terms

By accessing or using BCFSBO.ca ("the Website"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. These terms apply to all visitors, users, and others who access or use the Website.

2. Description of Service

BCFSBO.ca is an online platform that enables property owners in British Columbia, Canada to list their properties for sale by owner (FSBO). We provide a listing platform only. We are not a real estate brokerage, we do not represent buyers or sellers, and we do not provide real estate advice. The listing fee is $25 CAD per property listing.

3. User Accounts

To list a property, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and listing a property. You agree to notify us immediately of any unauthorized use of your account.

4. Property Listings

Accuracy: You represent and warrant that all information provided in your property listing is accurate, complete, and not misleading. You are solely responsible for the content of your listing, including descriptions, photos, and pricing.

Ownership: You represent that you are the legal owner of the property being listed, or that you have the legal authority to list the property on behalf of the owner.

Photos: You represent that you own or have the right to use all photos uploaded with your listing. By uploading photos, you grant BCFSBO.ca a non-exclusive license to display them on the Website in connection with your listing.

Prohibited Content: Listings must not contain false or misleading information, discriminatory language, illegal content, or content that infringes on the rights of others.

5. Fees and Payments

The listing fee is $25 CAD per property listing. Payment is processed securely through Stripe. All fees are non-refundable once a listing has been activated and published on the Website. We reserve the right to change our fees at any time, with notice to users.

6. Listing Duration and Removal

Listings remain active on the Website until the property is sold, the listing period expires, or the listing is removed by the user or by us. We reserve the right to remove any listing that violates these Terms of Service, contains inaccurate information, or is otherwise deemed inappropriate, without refund.

7. No Real Estate Advice

BCFSBO.ca is a listing platform only. We do not provide legal, financial, or real estate advice. We strongly recommend that sellers and buyers consult with qualified professionals, including real estate lawyers, home inspectors, and financial advisors, before completing any real estate transaction. We are not responsible for the outcome of any transaction between buyers and sellers.

8. Buyer Inquiries

Potential buyers may contact sellers directly through the contact information provided in listings. BCFSBO.ca is not a party to any communications or transactions between buyers and sellers. We do not verify the identity or intentions of potential buyers.

9. Limitation of Liability

To the fullest extent permitted by law, BCFSBO.ca and its owners, operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use the Website, any transactions between buyers and sellers, unauthorized access to your account, or any errors or omissions in listing content.

Our total liability to you for any claims arising from your use of the Website shall not exceed the amount you paid to us in listing fees during the twelve months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless BCFSBO.ca and its owners, operators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Website, your property listing, any transaction you enter into as a result of using the Website, or your violation of these Terms of Service.

11. Intellectual Property

The Website design, logo, graphics, and all content created by BCFSBO.ca are our intellectual property. You may not reproduce, distribute, or create derivative works from any part of the Website without our written consent. User-submitted content (listing descriptions, photos) remains the property of the user, subject to the license granted in Section 4.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law principles. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.

13. Modifications

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Website after any modifications constitutes acceptance of the updated terms.

14. Termination

We may terminate or suspend your account and access to the Website immediately, without prior notice or liability, for any reason, including if you breach these Terms of Service. Upon termination, your right to use the Website will cease immediately.
